I have a new computer that runs Vista. My smartphone(cingular 3125) uses
active sync 4.2 - that is not compatible with Vista (only up to XP) how can I
get my contacts from my phone into my laptop outlook? My old laptop is no
loinger available to export and save a .pst file.
If you cannot use the new mobile device sync center that ships with Vista, then you are left with copying them by hand, or using an older version of Windows with a compatible version of Outlook to get your contacts into Outlook and then export as a .csv file that you can import into Outlook on Vista.

No, there is no patch - Vista uses the new Mobile Device synching that only works on Windows Vista. Activesync is not supported on Windows Vista.
